Terms of Service

These Terms of Service ("Terms") govern your access to and use of ChromaHost ("the Service"), operated by justzvan ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you confirm that you have permission from a parent or legal guardian.
2. Your Account
You are responsible for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
3. Acceptable Use
You may not use the Service to:
- host or distribute malware, spyware, or any malicious code
- conduct denial-of-service attacks or network abuse
- host content that is illegal in the European Union
- infringe the intellectual property rights of any third party
- send unsolicited bulk messages (spam)
- mine cryptocurrency or abuse shared compute resources
- circumvent or attempt to circumvent resource limits
We reserve the right to determine, at our sole discretion, what constitutes a violation of this section.
4. Suspension and Termination
We may suspend or terminate your account at any time, for any reason, with or without notice. This includes, but is not limited to, violations of these Terms, inactivity, abuse of resources, or operational necessity.
You may delete your account at any time by contacting us. Upon deletion, your hosted projects and associated data will be removed within 30 days.
5. Resource Limits
Your use of the Service is subject to the resource limits of your plan. We reserve the right to modify, reduce, or remove plan allocations at any time. We will make reasonable efforts to notify you in advance of material changes.
6. Regions
The Service offers multiple deployment regions. You choose the region where your project is deployed. We make no guarantee that any specific region will remain available. We may add, modify, or remove regions at any time.
7. Service Availability
We make no guarantee of uptime, availability, or data durability. The Service is provided on a best-effort basis. We strongly recommend maintaining your own backups of any data or code deployed through the Service.
8. Limitation of Liability
To the fullest extent permitted by applicable law, we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Service. This includes, without limitation, loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you, for any cause and regardless of the form of action, will not exceed EUR 100.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
11. Third-Party Services
The Service integrates with Hack Club's authentication service. Your use of that service is subject to Hack Club's own terms and policies. We are not responsible for third-party services.
12. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Croatia, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Croatia.
